Temporary residence permit in Ukraine
If you want to stay on the territory of Ukraine more than 90 days on the basis of visa-waiver or visa regime, you must obtain temporary or permanent residence permissions.
Today we will talk about a temporary residence permit, and as a basis for obtaining a temporary residence permit, we will consider employment in Ukraine and marriage with a Ukrainian citizen.
Business temporary residency permit (working visa)
To begin with, we need to determine why we generally need such a document, let us consider employment in Ukraine, as a first reason. You can be hired as an employee in the Ukrainian company or set up your own business in Ukraine. As a result, you will get a work permit in Ukraine and a temporary residency permit.
Documents for work permit obtaining are stated in Article 42 2 of the Law of Ukraine “On employment of the population.” (https://zakon.rada.gov.ua/laws/show/5067-17#Text )
After getting a work permit you have to apply for a working (business) visa type D in the Ukrainian consulate abroad.
The list of documents that are requires for a temporary residence permit obtaining is indicated in paragraph 32,33 of the Resolution of the Cabinet of Ministers No. 322 of April 25, 2018. (https://zakon.rada.gov.ua/laws/show/322-2018-%D0%BF#Text).
Herewith, documents must be submitted to the State Migration Service and wait for a positive response. If you have a family, then after you receive a residence permit, they can also apply for a residence permit and the reason will be family reunification.
In the event you set up a company in Ukraine and get a work permit, your temporary residency permit is valid for 3 years. In case the Ukrainian company employs you, you can get a temporary residency permit that will be issued from 1 till 3 years.
Obtaining a temporary residence permit through marriage.
If in the first case, with employment in Ukraine, a residence permit is given for a maximum of 3 years, then a residence permit through marriage with a Ukrainian citizen is given for 1 year with the possibility of its extension.
The first step to obtaining a residence permit:
1) Registration of marriage.
2) After that, the foreigner will have to leave Ukraine and obtain a Visa D at the Embassy of Ukraine in connection with family reunification. The exceptions are Moldova, Russia, Georgia, Azerbaijan, Armenia, Belarus, Uzbekistan, citizens of these countries do not need to obtain a visa.
3) Now you can apply for a residence permit to the Migration office following the list of documents specified in paragraph 32,33 of the Resolution of the Cabinet of Ministers No. 322 of April 25, 2018. (https://zakon.rada.gov.ua/laws/show/322-2018-%D0%BF#Text) and do not forget that the residence permit must be renewed, and documents must be submitted no later than 15 days before the date of expiration.
